Module Information

This module explores federal and state statutory law – it’s creation and impact. As educators and educational administrators, it is important that we understand the influence of the legislative process on our educational practice. We also must be able to locate and analyze sections of codes or statutes on education.

To understand statutory law, you will need to find one federal and one state statute online from valid and reliable websites. I have provided optional resources that may be helpful for you as well as the various books and websites already referenced in other modules. You will need to read the complete statute in order to understand it, analyze it, and evaluate its impact on educational systems. You must analyze the statute and identify the major requirements or elements of the statute. Then, you must synthesize each major point and how it impacts educational process and practice.

Assignment Instructions & Requirements

The purpose of the paper is to explain two statutes to professional educators. The educators who comprise your audience of readers work in your area of specialization and are looking for you to explain the context of the statutes, the requirements to maintain compliance, and the overall impact on the work they do. To help you with Module 6 and 7, it is suggested that you choose statutes related to your Legal Guide topic.

To show mastery of the statutory law module, you will complete a written submission focused on two (2) statutes – one federal and one state statute. Other requirements for each of the 2 statutes include:

• Introduction and Historical Context: Introduce the statute and place it in historical perspective. Explain the reason for the law or act. What is the purpose? How and when did it originate? It is required that you locate the original source of law and not rely only on the codified version (see note below).

  • This section of your paper must name and cite the actual house
  • and senate bill and provide context. In this section for example, it would also be of interest to your reader that the No Child Left Behind Act is actually just an extension of the Elementary and Secondary Education Act and was written under the direction of Senator Ted Kennedy (not George Bush) or that the Violence Against Women Act Reauthorization was originally enacted under then Senator Joe Biden and reauthorized under his very active Vice Presidential administration.
  • Note about statutory law: Statutes are adopted by the state or federal legislature, so you will first want to identify the actual house or senate bill that resulted in the statute. After adoption by the legislature, statutes are placed in codes of law. Examples include the Texas Education Code, the Texas Family Code, and the United States Code. It is important to understand that the codes are “codified versions” of statutes and not the original source of law. The original source of law is the house bill or senate bill enrolled by the legislature. When you read the actual bills and compare them to what you find in the codes, you will notice that some acts revise multiple sections of codes. The means if you rely only on searching the Texas Education Code for a statute, you may not find the complete law. You have to go back to the original bill or act. To find the original bill or act, you can search the legislative archives or the codes will often have footnotes that indicate what legislative session or bill resulted in the item within the code.
  • Major Provisions:
  • In the text you must enumerate and briefly explain the major provisions or requirements of the act. This section should be a numbered or bulleted list of the major provisions with a brief explanation or summary of each. Each major point of the law must be numbered/bulleted and explained. Some legislation is quite large. For example, the Violence Against Women Act is lengthy and incorporates elements that do not relate to educational systems. If you choose a statute like this, you can focus only on bulleting provisions related to educational systems and summarize the broad scope of the other sections. If you are choosing a large statute, make sure that you tell your audience in the paper which provisions you are specifically focusing on and which ones you are summarizing broadly.
  • Discussion: As with your previous assignments. This is a critical concluding section that explains the relevance of this law to educational practice and to your audience. You must demonstrate the three higher levels of Bloom's Taxonomy in this paragraph. You can provide the reader a specific example of how the law is applied in your job.
  • References: References may immediately follow the discussion of each statute. You do not need to begin them on a new page. Remember! If you have an in- text citation, you must have a corresponding reference entry. If you have a reference entry, you must have a corresponding in-text citation. If you have

chosen a topic for Module 6 & 7, you can begin to use these assignments to relate to your specific topic. These discussion sections can be tailored to fit the topic of your choice.


  • I highly recommend that you outline the provisions of the act before you begin to write. This will save you a lot of wasted time.
  • Your primary source of information should be the actual law or act itself. It is all right to use study sources of information written about the law especially to learn its history. That is "academic" and a valid source of knowledge. Just do not rely on other authors to learn about the statute itself. You MUST read the statute, cite and reference the statute. This is required for Module 6 and 7 also. Rely on your interpretation of the law itself, not on what someone else says about it.
  • You may not use another author as a reference; your writing should ultimately be based on what you read and interpreted of the law itself.
  • Your paper will be approximately 4-5 pages long (1 page description of each statute and the major components/requirements and 1 page discussion/analysis of each statute)
  • APA-formatted (headings, spacing, page numbers, fonts, citations)
  • Cover page is not required
  • A separate reference page is not required, but APA and/or Bluebook citations should be listed following each statute summary (But remember your references will be very limited because this is a professional writing assignment, not an academic research paper)
